Terms of Service

These Terms of Service ("Terms") are an agreement between you and Gigamiga Solutions Ltd. ("we", "us") about your use of the Foldmania mobile game, its in-game items and the website https://foldmania.com (together, the "Service"). By downloading, installing or using the Service you agree to these Terms. If you do not agree, do not use it.

1. Who can use Foldmania

You must be at least 13 years old, or older if your country requires a higher age to use online services without a parent's consent. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian, who is responsible for your use and purchases.

2. Licence

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use Foldmania on devices you own or control, for your own non-commercial entertainment, subject to these Terms and the rules of the app store you downloaded it from. All rights not expressly granted are reserved. The game's software, art, characters, music, levels, names and logos belong to us or our licensors.

3. App store terms

You downloaded Foldmania from the Apple App Store or Google Play (the "Store"). These Terms are between you and us, not the Store. You must also follow the Store's terms of service and usage rules. In particular, if you use the iOS version:

  • These Terms are concluded between you and us only, and not with Apple. We, not Apple, are responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to a warranty that applies, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for addressing any claims about the app, including product-liability claims, legal or regulatory non-compliance, and consumer-protection claims, and for any third-party intellectual-property infringement claims.
  • You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

4. Free to play, optional purchases and virtual items

Foldmania is free to download and play. You can optionally buy coins, tools and packs ("Virtual Items") with real money through the Store, and you can optionally watch rewarded ads to earn coins.

  • Licence, not ownership. Virtual Items are a limited licence to use features inside the game. They have no cash value, cannot be exchanged for money or transferred to another person, and are not property.
  • Prices and taxes. Prices, currency and taxes are set and shown by the Store when you buy.
  • Payments and refunds. Payments are processed by the Store, not by us. Except where the law gives you a right to a refund, purchases are final. Refund requests are handled by the Store under its policy (for example Apple's "Report a Problem" or Google Play's refund process). Your statutory consumer rights are not affected.
  • No cloud wallet. Your coins, tools and progress are stored on your device and we do not currently offer accounts or cloud save. If you delete the app, clear its data, or change devices, your balances and progress may be lost, and we cannot guarantee that consumable items can be recovered. One-time purchases that the Store treats as restorable can be restored with Settings > Help & purchases > Restore purchases.
  • Changes. We may change, rebalance, add or remove Virtual Items, prices and game content, for example to fix bugs, prevent abuse or improve the game.
  • Not required to play. The puzzles can be completed without buying anything.

5. Ads

The game may show optional rewarded video ads provided by third parties (currently Google AdMob). Ads are only shown if you choose to watch one. We do not control the content of third-party ads and are not responsible for third-party products or websites you reach through them. See our Privacy Policy for how ad data is handled.

6. Acceptable use

You agree not to:

  • cheat, modify, or tamper with the game, its save data, purchases or ad flows, or use bots, scripts or other tools to gain an unfair advantage or obtain items without paying;
  • reverse engineer, decompile, extract or copy the game's code or assets, except where the law expressly allows it despite this restriction;
  • interfere with the Service, the Store, or third-party services the game relies on, or try to bypass security or payment checks;
  • use the Service for any unlawful purpose, or in a way that infringes others' rights;
  • sell, rent, sublicense or commercially exploit the game or access to it.

7. Intellectual property and feedback

You may not use our names, logos or art without written permission, except to the extent the law allows (for example fair reporting or review). If you send us ideas or feedback, you agree we may use them without restriction or payment, though we are not obliged to.

8. Updates, availability and changes

We may update the game, require updates to continue playing, or change or stop the Service (or parts of it) at any time. The game works offline for most play, but an internet connection is needed for purchases and ads. We do not promise uninterrupted or error-free service.

9. Termination

You can stop using the Service at any time by deleting the app. We may suspend or end your access if you breach these Terms or if we stop offering the Service. Sections that by their nature should survive (such as intellectual property, disclaimers, liability and governing law) will continue to apply.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee that the game will be free of errors or interruptions. Nothing in these Terms limits any rights you have under mandatory consumer-protection law.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, progress, Virtual Items, profits or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us through the Store in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, fraud, or any right that mandatory consumer law gives you.

12. Governing law and disputes

These Terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Yafo, Israel have exclusive jurisdiction, subject to mandatory consumer law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and nothing here prevents you from bringing a claim in your local courts where the law gives you that right.

13. Changes to these Terms

We may update these Terms from time to time. We will change the date at the top and, for material changes, give notice in the app or on this website before they take effect. If you keep using the Service after the changes take effect, you accept them. If you do not agree, stop using the Service.
